A BILL to amend and reenact article four, chapter thirty-one-a of
the code of West Virginia, one thousand nine hundred
thirty-one, as amended, by adding thereto a new section,
designated section thirty-b, relating to prohibiting bank
charges to recipients of worthless checks.
Be it enacted by the Legislature of West Virginia:

That article four, chapter thirty-one-a of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended and reenacted by adding thereto a new section, designated
section thirty-b, to read as follows:
ARTICLE 4. BANKING INSTITUTIONS AND SERVICES GENERALLY.
§31A-4-30b. Prohibition on fees banks may charge recipient of
returned or overdraft checks.
A banking institution may not charge a fee to the recipient of
check that was presented to the bank for payment or deposited into an account of the bank, and later returned as an overdraft or
worthless check.
NOTE: The purpose of this bill is to prohibit bank charges to
recipients of worthless checks.
